RentRooms.US Terms and Conditions of Service

Please read these Terms of Service ("Terms") carefully. By downloading, accessing, or using the website or other products or services of RentRooms.US.com, LLC and our affiliates ("RentRooms.US", "we", or "us"), or the services, features, or functionality jointly offered with other companies through our website (collectively, the "Service" or "Services"), you agree to be bound by these Terms. These Terms affect your legal rights and obligations, so if you do not agree to these Terms, do not use the Services.

In the event you use a service, feature, or functionality that is operated by a third party and made available through our Services (including Services we jointly offer with the third party), each party's terms will govern as to the respective party's relationship with you. In these instances, we will take steps to make the third party’s terms available to you before you begin to use the service, feature, or functionality. RentRooms.US is not responsible or liable for a third party's terms or actions taken under the third party's terms.

ARBITRATION NOTICE: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION CLAUSE BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND RentRooms.US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

1. Our Audience

RentRooms.US is intended for individuals who are at least 18 years old and need to find a roommate for a shared living unit. Persons under the age of 18 are prohibited from creating RentRooms.US accounts.

You affirm that you are either at least 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms. In addition, you affirm that you have not been previously suspended or removed from the Services and do not have more than one RentRooms.US account. You affirm that you are not a landlord or other apartment owner or lessor who is attempting to rent a space to anyone other than someone who wants to share your living unit with you.

We may, in our sole discretion, refuse to offer the Services to any person or entity. We may, without notice and in our sole discretion, terminate your right to use the Services, or any portion thereof, and block or prevent your future access to and use of the Services or any portion thereof.

2. Privacy

The RentRooms.US Privacy Policy is incorporated into these Terms. By accepting these Terms, you agree to the collection, use, and sharing of your information through the Services in accordance with the Privacy Policy, which is available at https://RentRooms.US.com#PP. If there is any conflict between the Privacy Policy and these Terms of Service, these Terms of Service prevail.

3. Fees and Costs

Basic membership is free. Basic members can add listings, browse matches, and send direct messages. Fees are charged on a Per Reservation basis dependent on the amount of the booking. All fees are non-refundable, even if you cancel before the expiration of your VIP Membership. If you do cancel your account before your VIP Membership expires, your VIP Membership will remain active until the expiration of the original VIP Membership upgrade period.

We also offer a verification service, provided through Blockscore, Inc., for $2.99. All verification data from this service is provided by Blockscore, Inc. and we have no control over the data, questions, or other information provided through this service. Blockscore, Inc. is solely responsible for the accuracy and completeness of the verification service. The $2.99 fee is non-refundable whether or not the verification process is successfully completed.

We also offer phone number verification services through Twilio, Inc. You agree that any and all phone, data, and SMS charges that result from the use of this verification service are at your own expense. We are not responsible for any charges incurred by you through your phone or internet service provider.

4. User Content

The Services consist of interactive features and areas that allow users to create, post, transmit, and store content, including but not limited to photos, text, graphics, items, or other materials (collectively, "User Content"). You understand that you are responsible for all data charges you incur by using the Services. You also understand that your User Content may be viewable by others on the Internet.

You agree that you are solely responsible for your User Content and any claims arising therefrom and that RentRooms.US is not responsible or liable for any User Content or claims arising therefrom. While we are not obligated to do so, we reserve the right, and have absolute discretion, to review, screen, and delete User Content at any time and for any reason.

You agree to provide true, accurate, current, and complete information about yourself as prompted by the Services' membership form (such information being the "Membership Data") and to maintain and promptly update the Membership Data to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or RentRooms.US has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, RentRooms.US has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

You retain all ownership rights in your User Content. However, by submitting User Content to RentRooms.US, you hereby grant us an irrevocable, nonexclusive, worldwide, perpetual, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, edit, publish, create derivative works from, distribute, perform, promote, exhibit, and display such User Content in any and all media or distribution methods, now known or later developed (the "User Content License"). Without limiting the foregoing, when you submit User Content to RentRooms.US, you agree that the User Content License accords RentRooms.US the right to sublicense such User Content to other companies, organizations, or individuals in any and all media or distribution methods, now known or later developed. No use of User Content in accordance with the User Content License shall entitle you to any compensation from RentRooms.US, or any other companies, organizations, or individuals.

5. Feedback

You agree that any feedback, suggestions, ideas, or other information or materials regarding RentRooms.US or the Services that you provide, whether by email or otherwise ("Feedback"), are non-confidential and shall become the sole property of RentRooms.US. We will be entitled to the unrestricted use and dissemination of such Feedback for any purpose, commercial or otherwise, without acknowledging or compensating you. You waive any rights you may have to the Feedback (including any copyrights or moral rights). We like hearing from users, but please do not share your ideas with us if you expect to be paid or want to continue to own or claim rights in them.

6. RentRooms.US Content

Unless otherwise stated, all materials contained on or within the Services, including, but not limited to, text, graphics, images, code, illustrations, designs, icons, photographs, video clips, and written and other materials (collectively, "RentRooms.US Content"), as well as their selection and arrangement, are protected by copyright, trademark, trade dress, patent, or other intellectual property laws. Unauthorized use of RentRooms.US Content may violate such laws and these Terms. Except as expressly provided in these Terms, RentRooms.US does not grant any express or implied rights to use RentRooms.US Content. You agree that you will not copy, reproduce, republish, frame, download, transmit, modify, display, reverse engineer, sell, or participate in any sale of, rent, lease, loan, assign, distribute, license, sublicense, or exploit in any way, in whole or in part, RentRooms.US Content, the Services, or any related software, except as expressly stated in these Terms.

You are hereby granted a limited, nonexclusive, non-sublicensable license to access and use the Services and RentRooms.US Content. This license is revocable at any time. This license is subject to these Terms and does not include:

The distribution, public performance, or public display of RentRooms.US Content;
Modifying or otherwise making any derivative uses of the Services or RentRooms.US Content, or any portion thereof;
Use of any scraping, data mining, robots, or similar data gathering or extraction methods;
Downloading (other than page caching) any portion of the Services, RentRooms.US Content, or any information contained therein, except as expressly permitted on the Services;
Any use of the Services or RentRooms.US Content other than for their intended purposes.

Any use of the Services or RentRooms.US Content other than as specifically authorized in these Terms, without the prior written permission of RentRooms.US, is strictly prohibited and will terminate the license to use RentRooms.US granted in these Terms.

You acknowledge and agree that RentRooms.US may preserve User Content and Membership Data and may also disclose User Content and Membership Data if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims that any User Content or Membership Data violates the rights of third-parties; or (d) protect the rights, property, or personal safety of RentRooms.US, its users, and the public.

7. Prohibited Activities

In addition to the other restrictions outlined in these Terms, you agree that you will not:

Use the Services for any purpose that is illegal, beyond the scope of their intended use, or otherwise prohibited in these Terms or the terms of any third party that govern a particular Service;
Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services in any manner;
Upload photographs or images that contain contact information, such as a phone number, email address, facebook profile name, etc;
Compromise the security of the Services;
Send any unsolicited or unauthorized advertising, spam, solicitations, or promotional materials;
Use any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Services or to extract data;
Reverse engineer any aspect of the Services or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any area, content, or code of the Services;
Use or attempt to use another user's account without authorization;
Attempt to circumvent any content-filtering techniques we employ or attempt to access areas or features of the Services that you are not authorized to access;
Attempt to indicate in any manner that you have a relationship with us or that we have endorsed you or any products or services without our express written consent to do so;
Engage in any harassing, intimidating, predatory, or stalking conduct;
Impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
Violate the publicity, privacy, or data-protection rights of others, including by taking pictures of another individual without receiving that individual’s consent;
Infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary rights of any party;
Buy, sell, rent, lease, or otherwise offer in exchange for any compensation, access to your RentRooms.US account or a RentRooms.US username without RentRooms.US’s prior written consent;
Create or maintain a listing for anything other than your individual intent to share a living space;
Develop any third-party applications that interact with User Content or the Services without our prior written consent; and
Use the Services for any illegal or unauthorized purpose or engage in, encourage, or promote any activity that violates these Terms.

8. Account Security

After opening a RentRooms.US account, you accept all responsibility for any activity that occurs while logged into your account. You are responsible for making sure that you keep your password secure and safe. You agree that you will not share your password with others or do anything that might jeopardize the security of your account, including sharing your password with or logging in through unauthorized third-party applications or clients. If you use any such application or client, you acknowledge and agree that RentRooms.US will bear no responsibility for any actions taken by those applications or clients, such as any breach of or unauthorized use of your account information or messages.

9. Modifications to the Services

We reserve the right to modify or discontinue, temporarily or permanently, the Services or any features or portions thereof without prior notice. You agree that we will not be liable for any modification, suspension, or discontinuance of the Services or any part thereof.

10. Copyright Policy

RentRooms.US respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, we strive to expeditiously remove any infringing material from our site. If RentRooms.US becomes aware that one of its users is a repeat copyright infringer, it is our policy to take reasonable steps within our power to terminate the user's account. All users should be aware of and comply with applicable copyright laws.

To be effective, any takedown notice submitted to our Copyright Agent must comply with the requirements set forth at 17 U.S.C. § 512(c)(3). That means that the notice must include substantially the following:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

THE RentRooms.US SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE RentRooms.US SERVICES ARE PROVIDED BY RentRooms.US ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. RentRooms.US MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE RentRooms.US SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE RentRooms.US SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE RentRooms.US SERVICES IS AT YOUR SOLE RISK.

RentRooms.US TAKES NO RESPONSIBILITY AND ASSUMES NO LIABILITY FOR ANY CONTENT THAT YOU, ANOTHER USER, OR A THIRD PARTY CREATES, UPLOADS, POSTS, SENDS, RECEIVES, OR STORES ON OR THROUGH OUR SERVICES. YOU UNDERSTAND AND AGREE THAT YOU MAY BE EXPOSED TO CONTENT THAT MIGHT BE OFFENSIVE, ILLEGAL, MISLEADING, OR OTHERWISE INAPPROPRIATE, NONE OF WHICH RentRooms.US WILL BE RESPONSIBLE FOR.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, RentRooms.US DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RentRooms.US DOES NOT WARRANT THAT THE RentRooms.US SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE), OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE RentRooms.US SERVICES, RentRooms.US' SERVERS, OR ELECTRONIC COMMUNICATIONS SENT FROM RentRooms.US ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RentRooms.US WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY RentRooms.US SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE), OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY RentRooms.US SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

12. Note to International Users

The Services are hosted in the United States. If you are a user accessing the Services from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through your continued use of the Services, which are governed by U.S. law, you are transferring your personal information to the United States and you consent to that transfer.

13. General Practices Regarding Use and Storage

You acknowledge that RentRooms.US may establish general practices and limits concerning use of the Services, including without limitation the maximum number of days that email messages, message board postings, Membership Data, or other uploaded User Content will be retained by the Services, the maximum number of email messages that may be sent from or received by an account on the Services, the maximum size of any email message that may be sent from or received by an account on the Services, the maximum disk space that will be allotted on RentRooms.US' servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Services in a given period of time. You agree that RentRooms.US has no responsibility or liability for the deletion or failure to store any messages and other communications or other RentRooms.US Content maintained or transmitted by the Services. You acknowledge that RentRooms.US reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that RentRooms.US reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

14. Termination

You agree that RentRooms.US, in its sole discretion, may terminate your password, account (or any part thereof), or use of the Services, and remove and discard any User Content within the Services, for any reason, including, without limitation, for lack of use or if RentRooms.US believes that you have violated or acted inconsistently with the letter or spirit of these Terms. RentRooms.US may also in its sole discretion and at any time discontinue providing the Services, or any part thereof, with or without notice. You agree that any termination of your access to the Services under any provision of these Terms may be effected without prior notice, and acknowledge and agree that RentRooms.US may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Services. Further, you agree that RentRooms.US shall not be liable to you or any third-party for any termination of your access to the Services.

15. Indemnification

By agreeing to these Terms you agree to indemnify, defend, and hold harmless RentRooms.US, our members, managers, officers, employees, affiliates, parent companies, subsidiaries, contractors, licensors, and suppliers (the "RentRooms.US Parties") from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys’ fees) due to, arising out of, or relating in any way to (a) your access to or use of the Services; (b) any User Content you post, upload, use, distribute, store, or otherwise transmit through the Services; (c) your violation of these Terms; (d) your violation of the rights of another, including without limitation, any intellectual property right, publicity, confidentiality, privacy, or propriety right; or (e) your violation of any statutes, codes, ordinances, laws, rules, regulations, including without limitation, all regulatory, administrative, and legislative authorities.

16. Limitation of Liability

Except where prohibited by law, in no event will RentRooms.US or the RentRooms.US Parties be liable for any indirect, special, punitive, incidental, exemplary, or consequential damages that result from (a) the use of, or inability to use, the Services; (b) the provision of the Services or any materials available therein; or (c) the conduct of other users of the Services, even if RentRooms.US has been advised of the possibility of such damages. You assume total responsibility for your use of the Services. Your only remedy against RentRooms.US for dissatisfaction with the Services or any content is to stop using the Services. If, notwithstanding these Terms, RentRooms.US is found liable to you for any damage or loss that arises out of or is in any way connected with your use of the Services or any content, RentRooms.US' liability shall in no event exceed the amount you paid for the Services over the last 12 months, or $100.00, whichever is greater. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.

17. Arbitration Agreement; Class Waiver; Waiver of Trial by Jury.

PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY REQUIRE YOU AND RentRooms.US TO AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION.

Applicability of Arbitration Agreement. You and RentRooms.US agree that all claims and disputes (whether contract, tort, or otherwise), including all statutory claims and disputes, arising out of or relating to these Terms or the use of the Services that cannot be resolved in small claims court will be resolved by binding arbitration on an individual basis, except that you and RentRooms.US are not required to arbitrate any dispute in which either party seeks equitable relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents. To be clear: The phrase "all claims and disputes" also includes claims and disputes that arose between us before the effective date of these Terms.
Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this dispute-resolution provision. Arbitration will be initiated through the American Arbitration Association ("AAA") and will be governed by the AAA Consumer Arbitration Rules, available here as of the date of these Terms, or by visiting the AAA web site at https://www.adr.org. If the AAA is not available to arbitrate, the parties will select an alternative arbitral forum. The rules of the arbitral forum will govern all aspects of this arbitration, except to the extent those rules conflict with these Terms. The arbitration will be conducted by a single neutral arbitrator. Any claims or disputes may be resolved through binding non-appearance-based arbitration, at the option of the arbitrator. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Additional Rules for Non-appearance Arbitration. If non-appearance arbitration is elected, the arbitration will be conducted by telephone, online, written submissions, or any combination of the three; the specific manner will be chosen by the arbitrator. The arbitration will not involve any personal appearance by the parties or witnesses unless the parties mutually agree otherwise.
Fees. If you choose to arbitrate with RentRooms.US, you will not have to pay any fees to do so. That is because RentRooms.US will reimburse you for your filing fee and the AAA's Consumer Arbitration Rules provide that any hearing fees and arbitrator compensation are our responsibility. To the extent another arbitral forum is selected, RentRooms.US will pay that forum's fees as well.
Authority of the Arbitrator. The arbitrator will decide the jurisdiction of the arbitrator and the rights and liabilities, if any, of you and RentRooms.US. The dispute will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator will have the authority to grant motions dispositive of all or part of any claim or dispute. The arbitrator will have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under law, the arbitral forum's rules, and the Terms. The arbitrator will issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. The award of the arbitrator is final and binding upon you and RentRooms.US.
Waiver of Jury Trial. YOU AND RentRooms.US WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and RentRooms.US are instead electing to have claims and disputes resolved by arbitration. Arbitration procedures are typically more limited, more efficient, and less costly than rules applicable in court and are subject to very limited review by a court. In any litigation between you and RentRooms.US over whether to vacate or enforce an arbitration award, YOU AND RentRooms.US WAIVE ALL RIGHTS TO A JURY TRIAL, and elect instead to have the dispute be resolved by a judge.
Waiver of Class or Consolidated Actions. ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS. CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER. If, however, this waiver of class or consolidated actions is deemed invalid or unenforceable, neither you nor we are entitled to arbitration; instead all claims and disputes will be resolved in a court as set forth in Section 18.
Right to Waive. Any rights and limitations set forth in this arbitration agreement may be waived by the party against whom the claim is asserted. Such waiver will not waive or affect any other portion of this arbitration agreement.
Small Claims Court. Notwithstanding the foregoing, either you or RentRooms.US may bring an individual action in small claims court.
Arbitration Agreement Survival. This arbitration agreement will survive the termination of your relationship with RentRooms.US.

18. Exclusive Venue

To the extent that these Terms allow you or RentRooms.US to initiate litigation in a court, both you and RentRooms.US agree that all claims and disputes (whether contract, tort, or otherwise), including statutory claims and disputes, arising out of or relating to the Terms or the use of the Services will be litigated exclusively in the City of Los Angeles, in the County of Los Angeles, California. If, however, that court would lack original jurisdiction over the litigation, then all such claims and disputes will be litigated exclusively in a court of competent jurisdiction in the County of Los Angeles, California. You and RentRooms.US consent to the personal jurisdiction of both courts.

19. Choice of Law

Except to the extent they are preempted by U.S. federal law, the laws of California, other than its conflict-of-laws principles, govern these Terms and any claims and disputes (whether contract, tort, or otherwise) arising out of or relating to these Terms or their subject matter.

20. Severability

What Personal Data We Collect and Process.

When you use the RentRooms.US Services, we collect personal data about you. “Personal Data” means any information that allows someone to identify you as defined under applicable law. Note that not all of the RentRooms.US Services collect all of the data listed below.

Personal Data You Provide

Account Credentials. For authentication purposes, we require you to provide an email address and password, a phone number, or a third-party social log-in (e.g., Facebook or Google) to use the RentRooms.US App or other RentRooms.US Services. In order to keep the RentRooms.US Services safe and authentic, we may ask for, and retain a hashed version, your phone number for account authentication and/or verification purposes. We use a third-party provider, Sinch, for this service. You can review Sinch’s privacy policy here.
Community Profile Information. When you create a RentRooms.US account, you choose to provide us Personal Data about yourself for your public RentRooms.US profile. For example, in the RentRooms.US App, you may voluntarily provide your Personal Data, such as your photo, display name, relationship status, ethnicity, age or date of birth, gender, pronouns, email address, height, weight, body type, position, social network link, “Looking For,” “About Me,” “Favorites,” “Blocks,” “Tribes,” “Meet at,” “Accept NSFW Pics,” and any other information that you add to your profile on the RentRooms.US App. You also have the option to voluntarily provide health characteristics, such as your Covid-19 status or Last Tested Date. Remember that if you choose to include information in your RentRooms.US community profile, that information will become public to other RentRooms.US users. As a result, you should carefully consider what Personal Data to include in your profile. Additionally, you can review and change your Community Profile Information at any time by accessing the “Edit Profile” section of the App.
Covid-19 Status/Last Tested Date. At the recommendation of Covid-19 prevention experts and the community of RentRooms.US users, we give you the option of publishing your health characteristics, such as your Covid-19 status and/or Last Tested Date, in your public RentRooms.US community profile. Remember that if you choose to include this information in your profile, it will become public to other users of the RentRooms.US App. As a result, you should carefully consider whether you want to disclose your Covid-19 status and/or Last Tested Date. You can review and change your Covid-19 Status/Last Tested Date information at any time by accessing the “Edit Profile” section of the App. In addition, RentRooms.US does not use Covid-19 status for advertising purposes and does not share this information with advertisers. Please note, in order to provide you the RentRooms.US Services, RentRooms.US shares this information only with third-party service providers performing functions essential to the RentRooms.US App such as companies that host data on our behalf (e.g., Amazon Web Services) or provide engineering support (e.g. RentRooms.US Taiwan Technology).
Feedback/Support. If you provide us feedback or contact us for support, we collect your name and e-mail address and possibly other Personal Data (e.g. IP address), as well as any other content that you send to us in order to reply and address any issue. If you contact us for support, we also collect and retain certain technical diagnostic data, such as your phone model. We may keep records of our communication with you, including any complaints we receive from you about other users (and from other users about you).
Mailing List. When you sign up for the RentRooms.US Services, we collect your email address to send you RentRooms.US news, RentRooms.US Services updates, the latest information on products and services, and third-party offers with your consent.
Surveys. When you participate in a survey, you provide us additional Personal Data through the survey. If the survey is provided by a third-party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information. Partner Promotion. We collect Personal Data if you provide such data in the context of a Partner Promotion (described below).
Personal Data We Receive When You Use RentRooms.US Services

Photos and Videos. If you wish to upload a photo or video to your RentRooms.US community profile or chat messages, you will be required to permit RentRooms.US to access your camera and photo gallery, in which case RentRooms.US will have access to the photos and videos stored in your photo gallery.
Location and Distance Information. When you use the RentRooms.US App, we collect your precise location (e.g. your latitude and longitude) ("Location") to determine your distance in feet or meters from other users (“Distance Information”). When determining an iOS users’ Location, the RentRooms.US App utilizes the iOS Core Location and Map Kit framework. To determine an Android users’ Location, the RentRooms.US App utilizes the Google Geolocation API. Both of these frameworks utilize various technologies to determine Location, including Internet Protocol (IP) address, GPS, and other sensors in your device that provide information on nearby devices, Wi-Fi access points, wireless networks, and cell towers and the RentRooms.US App relies solely on these frameworks in determining your Location. We store your last known Location to calculate Distance Information (please see Data Retention section for more information). Should you choose not to allow the RentRooms.US App to access your Location, certain features (such as displaying nearby user profiles or features that include Live Location Sharing) of the RentRooms.US Services will not function properly. You may also revoke this permission and disable the location services on your device. You can do so on an iPhone by going to settings, privacy, location services, RentRooms.US; and on Android, by going to settings, location, RentRooms.US, permissions, location.
Messages. When you send a message using the RentRooms.US Services (which could include photos, location, audio, or video) to other users of the RentRooms.US Services, we may collect Personal Data that includes the content of the message, including photos, location, audio, or video.
User Activity. We collect certain Personal Data that is generated through your use of the RentRooms.US Services. This Personal Data includes information about whose user profiles you have viewed, products and services you have purchased through the RentRooms.US Services and how you communicate with other users.
Hardware and Software Information. We collect certain hardware and software information about you and your device such as device make, device model, carrier, data connection type, browser type, operating system, IP address, domain name, date/time stamp for your visit, app crashes, advertising IDs (such as Google’s AAID and Apple’s IDFA which can be reset by going to your device’s setting) an ID that is unique to the device or browser on which you install and/or access the RentRooms.US Services (“Device ID”) and may collect sensor information such as barometric pressure, accelerometer measurements, gyroscope measurements, device orientation, magnetic field measurements, direction of travel, motion activity (e.g.,walking) or other similar measurements (all of the foregoing collectively known as “Hardware and Software Information”. In addition, when you use the RentRooms.US Services, we may collect information about other applications installed on your device, including the settings and characteristics of those applications. Cookies, Log Files and Other Tracking Technologies. We use cookies and URL information to gather information regarding the date and time of your visit and your searches. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until you delete them) to provide you with a more personal and interactive experience on the RentRooms.US Services and to improve our marketing efforts, including through the use of targeted advertising. Personal Data We Receive from Third Parties

Purchase Information. When you choose to make a purchase through the RentRooms.US Services, you submit Personal Data such as your name, payment card information, billing information, address, telephone number, and email address to one of our third-party payment processors.
RentRooms.US does not receive or process payment card information directly; however, our third-party service providers may provide certain information to us (e.g., your name, phone number, partial payment card number, and email address). We use Stripe or Google Play for purchases on Android devices, Apple for purchases on Apple devices, and Stripe for purchases on RentRooms.US Web Chat. Third-Party Platforms. If you use or connect to the RentRooms.US Site or download the RentRooms.US Services through a third-party platform, such as Facebook, Google, or WeChat, you allow us to access and/or collect certain information(e.g., date of birth) from your third-party platform profile/account (“Third-Party Data”). We may also access information contained in cookies placed on your device by the third-party platform. Remember, when you elect to create a RentRooms.US account via a third-party, you are also giving them Personal Data, so we recommend you read their privacy policies as RentRooms.US does not control how they use your information.
Third-Party Tracking. Our advertisers and certain service providers also use their own cookies or other tracking technologies (such as software development kits or “SDKs”) which may collect information about you within the RentRooms.US Services. Automated Decision-Making.

Your safety and security are important to us. As such, we use automated decision-making as a part of our platform moderation efforts (for example, removing spammers) in order to ensure our platform is inclusive, safe, authentic, and open for all RentRooms.US users to make connections. Automated decision-making assists us in our attempts to prevent and respond to illegal, malicious, and unauthorized activity. If you are notified that your account has been banned and you believe this is an error, please email a Customer Support representative at support@RentRooms.US.com to seek an appeal.

How We Share Your Personal Data.

We share Personal Data in the following situations:

Distance Information. The RentRooms.US App is designed to allow users to share Distance Information. Distance Information is public and indicates to other users of the RentRooms.US App the distance you are in feet or meters from them. RentRooms.US App users can use the explore feature in the RentRooms.US App to search.for other users in a geographic location outside of their immediate location. Your Distance Information will be displayed in your profile in those users' search results should you elect to display your relative distance. Sophisticated users who use the RentRooms.US App in an unauthorized manner, or other users who change their location while you remain in the same location, may use Distance Information to determine your exact location and may be able to determine your identity. Please note, you may choose to hide your Distance Information; however, the RentRooms.US App will continue to sort and display your profile based on your relative distance from other users. Accordingly, even if you choose to hide your Distance Information, others may nevertheless be able to determine your Location. You can disable location services on an iPhone by going to settings, privacy, location services, RentRooms.US and on Android, by going to settings, location, RentRooms.US, permissions, location.
Third Party Tracking Companies. When you sign up for the RentRooms.US Services we share your hashed Device ID, a portion of your Profile Information, Location Information, and demographic information with analytics partners. These third parties may also collect information directly from you as described in this Privacy Policy through tracking technologies such as cookies. The privacy policies of these third-party companies apply to their collection, use and disclosure of your Personal Data. For example, one of our partners is Google Analytics which collects information and reports website trends without identifying individual visitors. Another partner, Braze, provides us with the technology to allow us to collect certain information and reports on usage trends without identifying individual visitors (e.g., daily active users, monthly active users, time in app, etc.) and tools which allow us to communicate with users (via an inbox message) within the RentRooms.US App or out of app (e.g. via push notifications or email). Such user communications allow us to message users based on criteria, such as Location, certain profile information, and/or user activity in the RentRooms.US App. Note that we do not share information about your Tribe or your Covid-19 status with third-party analytics companies. Third-Party Advertising Companies. We share your hashed Device ID, your device's advertising identifier, a portion of your Profile Information, Location Information, and some of your demographic information with our advertising partners. These third parties may also collect information directly from you as described in this Privacy and Cookie Policy through tracking technologies such as cookies. The privacy policies of these third-party companies apply to their collection, use and disclosure of your Personal Data. One of these advertising partners is MoPub that helps RentRooms.US deliver personalized advertising. You can follow the links to MoPub’s privacy notice and partner page. Note that we do not share information about your Tribe, your Covid-19 status [or your Last Tested Date] with any advertising companies. Third-Party Service Providers. We share your Personal Data with third-party service providers to: provide you with the RentRooms.US Services; conduct quality assurance testing; monitor activity on the RentRooms.US Services; provide technical support; and/or to provide other services to RentRooms.US. Except as otherwise stated in this Privacy Policy, these third-party service providers are required by contract not to use your Personal Data other than to provide the services requested by RentRooms.US. Please note that Amazon Web Services, our data infrastructure provider, and certain employees of RentRooms.US Taiwan Technology Ltd., a provider of essential engineering services, have access to your Covid-19 and Last Tested Date information.
Partner Promotion. From time-to-time we may offer contests, sweepstakes, or other promotions with third-party partners. If you decide to enter a contest, sweepstake, or promotion that is sponsored by a third-party partner the information that you provide will be shared with us and with them. Business Transactions. If another company acquires our company, business, or assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy and Cookie Policy.
Other Disclosures With Your Consent. We may explicitly ask if you would like us to share your information with other third parties who are not described elsewhere in this policy. For example, we may ask you if you would like to back-up your account, or the information stored within your local device, to a third-party back-up service such as Apple or Google cloud backup.
Legal Obligations. RentRooms.US may preserve or disclose Personal Data in response to a lawful legal requeest, including: subpoenas, warrants, or court orders, or in connection with any legal process; to comply with relevant laws; to establish or exercise our rights to defend against legal claims; if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, safety of person or property, violation of our policies, or as otherwise required by law.
You share your Personal Data in the following situations:

Community Profiles. The RentRooms.US App is a social networking platform that is designed to allow users to connect and share information. When you use the RentRooms.US App, your Community Profile Information is public, and other users of the RentRooms.US App can see your Profile Information and other Personal Data (including sensitive personal data) posted by you. For example, other users can search for you, search for your profile characteristics, see if you’ve viewed their profile, or see you listed as being within their vicinity. Do not include information in your profile that you want to keep private. For example, if you do not want your Covid-19 status to be known, you should not include that information in your RentRooms.US profile. While the RentRooms.US App permits you to make certain items (e.g., Profile Information, preferences, or other information) non-public, sophisticated users who use the RentRooms.US App in an unauthorized manner may nevertheless be able to obtain this information and may be able to determine your identity.
Messages. You may choose to send messages, including photos, audio, location or videos, to other users. If you send messages, you will be providing RentRooms.US with your Personal Data as well as the user who views your message. Please don't send messages or share content that you wouldn't want someone to save or share as users may save content or copy it outside the RentRooms.US App. Please note, chat messages are stored locally on devices. Therefore, if you choose to delete your account, any chat messages you sent to another user may still be available on the other user’s device. Do not share your Account Credentials or payment information via chat (or any third-party platforms).
Live Location Sharing. You may elect to utilize the “Live Location Sharing” feature. If you use this feature, you share your specific location with another user for a predetermined period of time, as well as with RentRooms.US. Please note that while the Live Location Sharing is active, your Location is continuously shared in the background. You can revoke your consent to this sharing at any time by utilizing the in-app “stop sharing” button.
Social Features. The RentRooms.US Services include features that are designed to permit interactions that you initiate between the RentRooms.US Services and third-party websites or services, including third-party social networks (collectively, "Social Features"). For example, you may be able to "like" or "share" content from the RentRooms.US Services on other websites or services, such as Facebook, Twitter, Instagram, YouTube and LinkedIn. If you use Social Features on the RentRooms.US Services, both RentRooms.US and the third-party services that operate those Social Features may have access to certain Personal Data about you and your use of both the RentRooms.US Services and theirs. The Personal Data we collect in connection with your use of Social Features, such as usage information, is subject to this Privacy and Cookie Policy. The Personal Data collected and stored by third parties remains subject to those third parties' privacy practices, including whether the third parties continue to share Personal Data with us, the types of Personal.
You agree and consent that the information and data outlined above may be shared with third parties as described throughout this document.

Data Retention.

We retain your Personal Data for no longer than is necessary to fulfill the purposes for which the information was collected (as indicated above), or as otherwise permitted or required by applicable law or pursuant to RentRooms.US Terms of Service or RentRooms.US Community Guidelines. Generally, RentRooms.US does not maintain user chat messages for longer than 24 hours once the message has been delivered to the recipient.

If you delete your account from within the RentRooms.US App, or instruct RentRooms.US to delete it on your behalf, your Profile Information and Location Information associated with your account will be removed from our systems within seven (7) days, unless retention is required for a legal propose. Chat images, user activity, and other Personal Data outlined above is deleted within 120 days of an account deletion. With respect to accounts that have been banned for violations of the RentRooms.US Terms of Service and/or Community Guidelines, RentRooms.US retains the hashed authentication mechanism used to create the account (e.g., phone number, email address, etc.) and limited log information associated with the reason for the ban. In some circumstances, RentRooms.US may retain chat messages used for reporting violative behavior resulting in an account’s ban.

Please note, as chat messages, images, and recordings are retained locally on user devices, chat messages, images, and recordings you have shared with other RentRooms.US users may still be retained on the recipient user’s device even after you have deleted your account.

How We Protect Your Personal Data.

At RentRooms.US, we take the privacy and security of your Personal Data seriously. We have a dedicated data security team that actively works to monitor the integrity and safety of the RentRooms.US Services. We have strict policies in place to help ensure your Personal Data is protected. We consistently strive to improve our defenses in the ongoing battle against bad actors. As such, we do not disclose any specific security tools or techniques we use so that we can better protect your Personal Data as we do not want to unwittingly educate those with malicious intent. That said, no method of transmission over the Internet, or method of electronic storage, is fully secure, and RentRooms.US cannot guarantee the security of your Personal Data. In the event that we are required by law to inform you of any unauthorized access to your Personal Data, we may notify you electronically, in writing, if permitted to do so by law.

Your Choices.

You can make the following choices regarding your Personal Data:
Community Profile Information. When you create a RentRooms.US account, you choose to provide us Personal Data about yourself for your public RentRooms.US community profile. You can review and change your Community Profile Information at any time by accessing the “Edit Profile” section of the App.
Promotional Emails. You may choose during the registration process to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials related to RentRooms.US and/or the RentRooms.US Services, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that you receive. If you unsubscribe from receiving such promotional emails, we may still send you service-related communications, and our applications may deliver notifications directly to your mobile device in the RentRooms.US Ap.
Behavioral Advertising On Websites. Our websites may allow for third-party behavioral advertising. This means that a third party may use technology (e.g., a cookie) to collect information about your use of our websites so that they can provide advertising about products and services tailored to your interests. For more information on third-party tracking technology, please visit Cookie Information below. That advertising may appear either on our website, or on other websites not operated by RentRooms.US. If you do not want third parties to collect information about your use of the RentRooms.US Services, or your affiliation to RentRooms.US, or to tailor any of the advertising that you see, you can opt out from some third party behavioral advertising at the Digital Advertising Alliance in the US, the Digital Advertising Alliance of Canada in Canada, or the European Digital Advertising Alliance in Europe. Please note that opting-out of behavioral advertising does not mean that you will not receive advertising while using the RentRooms.US Services. Behavioral Advertising Within The RentRooms.US App. If you are using the RentRooms.US Services on an Apple iOS device, you can opt-out of behavioral targeting by going into Settings > Privacy > Advertising on your iOS device, or visiting Apple’s website for more information. To opt out on an Android device, open the “Google Settings,” click on “Ads” and enable “Opt out of interest based ads.” Please note that opting-out of behavioral advertising does not mean that you will not receive advertising while using the RentRooms.US Services. It will, however, exclude you from interest-based advertising conducted through participating networks, as provided by their policies and choice mechanisms.
Third-Party Tracking. You may opt-out of Google Analytics' collection and use of your Personal Data by following the instructions here to download an opt-out browser add-on.

Your Rights.

You have the following rights regarding your Personal Data:

You transfer your Personal Data to us in the United States. If we transfer your Personal Data onward to a jurisdiction not deemed by the European Commission to provide an adequate level of personal data protection, the transfer will be based upon one of the following safeguards recognized by the European Commission as providing adequate protection for Personal Data:
Contracts approved by the European Commission which impose data protection obligations on the parties to the transfer.
The EU-U.S. Privacy Shield Framework (for transfers to third parties in the United States that have self-certified to the Framework).
RentRooms.US complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Data transferred from the European Union and/or Switzerland, as applicable, to the United States. RentRooms.US has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of Notice; Choice; Accountability for Onward Transfer; Security; Data Integrity and Purpose Limitation; Access; and Recourse, Enforcement, and Liability. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. RentRooms.US has submitted its self-certification to the Privacy Shield and will update this Privacy Policy with approval from the governing authorities as appropriate.
Please note that in certain situations, RentRooms.US may be obligated to disclose Personal Data in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.
In accordance with the EU-U.S. Privacy Shield and Swiss-US Privacy Shield Principles, RentRooms.US is committed to resolving privacy complaints regarding our Personal Data practices. For RentRooms.US App users in India or communicating with users in India: RentRooms.US may utilize an Amazon Web Services relay server based in Mumbai, India. The relay server does not typically store user data but facilitates the transmission of user data to the United States.

California Civil Code 1798.115(c), 1798.130(a)(5)(c), 1798.130(c), and 1798.140 indicate that organizations must disclose what categories of information are “collected,” “sold,” or transferred for an organization’s business purpose” as those terms are defined under California law. Permissible Age.
